Implementasi Pendampingan Anak Berkonflik Hukum Dalam Pelaksanaan Proses Penegakan Hukum Berdasarkan Sistem Peradilan Pidana Indonesia

Abstract
In dealing with children in conflict with the law, children must be differentiated from adults at every level of the process, so that children must be accompanied by a companion during the criminal justice process in accordance with Article 23 of Law no. 11 of 2012 concerning the Juvenile Criminal Justice System states that children who are in conflict with the law during the judicial process must be accompanied by Community Counselor or other companion in accordance with statutory regulations. However, the fact is that children are still found who do not receive assistance in undergoing the criminal process. This research aims to examine the implementation of assistance for children in conflict with the law. The method that the author uses is a normative juridical approach assisted by empirical juridical, with analytical descriptive research specifications and qualitative juridical analysis methods. Based on the research results, it shows that assistance for children in conflict with the law has not been implemented optimally, even though every child in conflict with the law must be accompanied by a community counselor and other companions, if one of them is not included then the legal sanction that applies is the decision to be null and void.
