Analisis Filsafat Hukum Teori Immanuel Kant Dalam Konteks Kebebasan Yang Dikaitkan Dengan Konflik Antara Israel Dan Palestina

Abstract

One of the principles emphasized by Kant is the principle of universality, namely that moral actions must be acceptable to everyone in similar situations. In the context of the Israeli-Palestinian conflict, an analysis linking Kant's theory of freedom can help us consider whether the actions of both sides are universally acceptable and just. The author aims to study, understand, and analyze Immanuel Kant's views regarding the theory of freedom and to study, understand, and analyze the application of Immanuel Kant's principles regarding freedom in relation to the tension conflict between Israel and Palestine. In accordance with the title and problems that will be discussed in this research and in order to provide useful results, this research was carried out using descriptive analysis research. The approach method used in this research is normative juridical. The research stage in this journal is the bibliography stage, which is carried out to obtain secondary data, namely secondary materials and tertiary materials. The data collection technique in this journal is document study. The analytical data used in this journal is qualitative juridical. The conclusion obtained is that Immanuel Kant's view regarding the theory of freedom is the fundamental principle and nature of humans who have rational abilities that differentiate humans from other creatures, and freedom is the power to follow moral laws produced by reason. And the application of Immanuel Kant's principle regarding freedom in relation to the tense conflict between Israel and Palestine is where Kant's theory of freedom can be linked to efforts to achieve a just solution and respect human rights for both parties, in this context the parties involved in the conflict between Israel and Palestine need to be reminded not to use excessive force and ensure the protection of individual rights and freedoms.
