Tinjauan Terhadap Fenomena LGBT Dikaitkan Dengan Teori Dentologi Dalam Sistem Hukum Nasional

Abstract

The phenomenon of Lesbian, Gay, Bisexual and Transgender (LGBT) was in an uproar in Indonesia because of the large number of LGBT communities that began to appear in the midst of people's lives. The LGBT phenomenon in Indonesia itself raises pros and cons for various groups, as well as regulations regarding LGBT in Indonesia which are still unclear in their direction. This research was conducted in a descriptive analytical manner with the approach method used, namely a qualitative normative approach using the relevant theory, namely Immanuel Kant's theory of deontology. The results in this study illustrate that the LGBT phenomenon is not in accordance with the national legal system in Indonesia because the Indonesian state strongly adheres to religious norms where when viewed from the marriage law, it is explained that marriage can be said to be valid if it is carried out by a pair of men and women. It is seen from the perspective of Deontology, that deeds become good are not seen from the results but because the deeds are obligatory to be done. Based on the analysis of the literature review, it was found that deontology does not fully justify the existence of LGBT.
