PERUBAHAN FUNDAMENTAL HUKUM EKONOMI : DALAM STUDI KASUS UMKM SETELAH DISAH KANNYA UU OMNIBUSLAW

Abstract

The purpose of this study is to find out how Economic Growth and the existence of Economic Law are after the enactment of Law Number 11 of 2020 concerning Copyright in Creation or commonly known as the Omnibus Law, which refers to its impact on micro, small and medium enterprises (MSMEs). Many think that the enactment of Law Number 11 of 202 concerning Job Creation hinders economic growth because there are many provisions that are considered detrimental to workers, but apart from this there are provisions that can cause this economic growth to progress in an even better direction. . As a result of the existence of the Ciptaker Law, regulations regarding Economic Law have become increasingly widespread. The subject of this research is the fundamental changes in Economic Law after the passage of the Job Creation Law in terms of changes in Indonesia's economic development and legal protection for micro, small and medium enterprises after the enactment of Law Number 11 of 2020 concerning Job Creation. The method used by the author in this research is library research. The results of the study show that the passage of the Job Creation Law shows a fundamental change to the current economic growth which is bridged by the increasing proliferation of MSMEs. Common problems of MSMEs are legal problems and debts to partners. In addition, the protection of MSMEs is well regulated by the Job Creation Law and PP No. 7 of 2021, specifically related to legal protection, because the central and regional governments are currently paying more attention to financing MSMEs that submit legal requests, assistance and support services. such as legal advice, mediation and out-of-court assistance.
