Abstract

Positivism is a school of philosophy. Positivism has a close relationship with (theory) of law, positivism which thinks that legal theory is only related to positive law. Positive law which means here is written law. Basically, legal science does not discuss the good and bad of positive law, nor does it discuss the effectiveness of law in society. This study aims to determine the extent to which the influence of positivism towards the renewal of the legal system in Indonesia. The research method used in this research is descriptive analytical method. While the approach method that we use in this study is qualitative, this method is a method in philosophical research that is deductive and idealistic in nature. The results of this study indicate that the influence of positivism is very large on the renewal of the legal system in Indonesia, because the process of reforming the legal system in Indonesia is currently inseparable from the rational views of legal experts on a problem, especially those who adhere to positivism.
