Abstract

The misuse of tourist visas for illegal work activities has become an increasing issue in Indonesia, despite regulations explicitly prohibiting work under a visit visa. Law enforcement that prioritizes administrative actions such as deportation over criminal prosecution raises concerns about the effectiveness of the legal system. This study aims to analyze the legal framework and enforcement challenges regarding the misuse of tourist visas in Indonesia. The method used is a normative juridical approach through literature review of immigration regulations, scientific journals, and other relevant legal sources. The results show that although regulations are quite strict, implementation in practice remains weak and administrative in nature. The main causes of visa misuse include lack of legal awareness, economic pressure, and emergency conditions. This study recommends simplifying work visa procedures, enhancing inter-agency coordination, and imposing stricter sanctions as preventive measures to reduce similar violations in the future.
