Transformasi Paradigma Hukum Di Indonesia: Analisis Aktualisasi Critical Legal Studies

Abstract

As the legal paradigm continues to undergo transformation, this research wants to highlight the role of Critical Legal Studies (CLS) in analyzing and interpreting legal dynamics in Indonesia. CLS as a theoretical approach emphasizes the importance of understanding the dimensions of power and inequality that underlie the legal system. In the Indonesian context, where social and political changes occur intensively, CLS becomes relevant because it is able to challenge traditional concepts and raise critical questions regarding justice, power and legal structures. The transformation of the legal paradigm in Indonesia cannot be avoided along with changes in social, political and economic dynamics. Factors such as globalization, cultural plurality, and demands for social justice are the main drivers of this shift. Through CLS analysis, the research aims to explore the impacts and implications of the transformation of the legal paradigm in Indonesia. By focusing on critical aspects such as hegemony, social justice, and legal interpretation, this research seeks to provide a deeper understanding of shifts in the understanding and implementation of law in Indonesia.
