Filsafat Hukum dalam Realisasi Prinsip Keadilan
Main Article Content
Abstract
This paper aims to comprehensively investigate and describe philosophical thinking about Legal Philosophy in the Realization of the Principles of Justice. In this context, this study proposes a hypothesis detailing three important aspects. First, the hypothesis states that law enforcement has a central role in realizing justice, as well as providing legal certainty and guarantees of the principles of justice. Second, this paper proposes that descriptions of a sense of justice should be integrated into applicable positive law, creating a solid foundation for the enforcement and understanding of justice in everyday legal practice. Finally, the third hypothesis states that Legal Philosophy has a crucial role in seeking the deepest meaning of final legal results, detailing the policies that underlie the formation of legal norms and legal decision making. Thus, through a detailed analysis of this hypothesis, this paper will dig deeper into how the concept of Legal Philosophy makes a real contribution to the realization of justice in the legal system. This research will examine the philosophical concepts that underlie the understanding of justice, explain how law enforcement can be a key instrument in achieving this goal, and discuss the importance of integrating justice values in applicable positive law. Apart from that, this article will also investigate how Legal Philosophy plays a role in exploring the deepest meaning of legal outcomes, leading to a deeper understanding of the wisdom behind the formation of legal norms and legal decision making. Thus, it is hoped that this paper can provide deeper insight into the role of Legal Philosophy in the context of achieving justice in the legal system.
