Perspektif Masyarakat Terhadap Keberadaan Hukum

Abstract

This research aims to examine the community's perspective on the existence of law, specifically focusing on the community and the philosophy of law. The study utilizes a literature review method based on the topic and the philosophical perspective of law in society. Based on the findings of the literature review conducted, there are several phenomena related to the community's perspective on the prevailing law, which serves as the foundation for the community. Generally, the community holds diverse views on the law. Various perspectives emerge due to ignorance and a lack of knowledge, the influence of customary and cultural values, critiques of laws not grounded in theory, demands for fair laws, media and education, and the presence of social and legal changes following the times. If the community's perspective on legal philosophy is positive, the public's trust in the law will be strong, and the implementation of rights and duties of the community becomes more binding. However, it should also be remembered that having a perspective is an individual right, so these views should not lead to debates but rather contribute to knowledge about the law, both practically and philosophically.
