Etika Kemasyarakatan Profesi Polri Yang Melakukan Kekerasan Terhadap Pengunjuk Rasa

Abstract
As a democratic country, the freedom of expression in public or demonstrations is regulated comprehensively in Article 28 of the 1945 Constitution of the Republic Indonesia which states that "Freedom of association or assembly, to express thoughts orally or in writing and as stipulated in law". The freedom to express opinions in public in reality involves a law enforcement institution, because administratively the action masses must notify the Indonesian National Police to hold a demonstration. In carrying out its duties and functions, the police has a scope of ethical codes, one of which is community ethics. Therefore, the purpose of this research is to comprehensively examine and discuss the application of community ethics of the police profession that commits violence against protesters and the legal consequences that will arise if the police violates the code of ethics. This research method uses qualitative research with a normative juridical approach. The result of this research is that community ethics in the Police profession who commit violence against protesters must be applied because it is important to maintain a balance between law enforcement and citizens rights. Given that community ethics is one of the scopes of the code of ethics of the Indonesian National Police, it means that in carrying out their duties and functions as law enforcers, the Police must follow the rules regarding the professional code of ethics. And the legal consequences if members of the Police commit violations of the code of ethics are that the Police usually have an internal mechanism to deal with violations of the code of ethics and also a more serious legal process if violations of the code of ethics involve violations of the law.
