Abstract

Violations of the code of ethics committed by Constitutional Court Judges have occurred several times. Constitutional judges are positions that carry out the authority of the Constitutional Court as actors of judicial power. Therefore, the role of constitutional judges determines the implementation of the Constitutional Court, one of whose functions is as guardian of the constitution (the guardian). of the constitution). Ethics is the foundation of a profession and ignoring moral values, a discourse of thought about the code of ethics for the judicial profession emerges. In principle, the judge's professional code of ethics contains moral values that underlie professional personality, namely freedom, fairness and honesty. However, there was another violation of the code of ethics committed by the Chief Judge of the Constitutional Court through the publication of Constitutional Court Decision No. 90/PUU-XXI/2023 which was assessed by the Chief Judge of the Constitutional Court as violating several provisions of Constitutional Court Regulation no. 02/PMK/2003. This research focuses on the application of the code of ethics to judges who violate the provisions of the code of ethics and behavioral guidelines for judges that have been regulated in various judicial regulations. One of the important points discussed in this research is violations of the code of ethics committed by judges because they have a conflict of interest, and its relevance is linked to Constitutional Court Regulation No. 02/PMK/2003. This regulation emerged with the aim of ensuring that the judges of the Constitutional Court do not cross the line into carrying out arbitrary actions or decisions and of course so that the justice carried out by the judges of the Constitutional Court runs well, according to the rules and is moral. The method used in writing this journal is normative juridical research which is carried out by examining library materials or secondary data.
