Perlindungan Hukum Terhadap Anak Korban Pencabulan Yang Mengalami Reviktimisasi (Viktimisasi Sekunder)

Abstract
The case of reporting on the release of perpetrators of sexual abuse illustrates that Indonesia is still unable to implement Law Number 35 of 2014 concerning Discussions on Law Number 23 of 2002 concerning Child Protection, because even with the existence of the law it turns out that child victims can still become victims. also known as re-victimization. Based on this description, the authors found two problems, namely 1) What is the category of victims of sexual abuse who experienced re-victimization (secondary victimization)? and 2) What is the legal protection for child victims of sexual abuse who experience re-victimization (secondary victimization). The specification of the research used by the authors is descriptive analysis, the approach method used by the authors is normative juridical method, the data collection technique used by the authors is document study while the analytical method used by the authors is qualitative juridical. The conclusion obtained by the authors is that the category of victims of sexual abuse who experience re-victimization (secondary victimization) can be categorized as a biological weak victim in which the victim is a child, who is physically and psychologically or mentally vulnerable to becoming a victim, one of which is a victim of a sexual crime or specifically victims of sexual abuse. And legal protection for child victims of abuse who experience re-victimization (secondary victimization) as stipulated in Article 76E of Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection, is entitled to legal protection as specified in Article 5 of the Law -Law Number 31 of 2014 concerning Amendments to Law Number 13 of 2006 concerning Protection of Witnesses and Victims.
