Abstract
It is common for a legal relationship to be classified as a legal act, between legal subjects and between legal entities. The position of the lease agreement in terms of other lease rights is transferred without the owner of the land and building giving his consent. This research uses descriptive and analytic research methods. Issues that have been found through data collection are then analyzed and assembled using theories. Since the tenant doesn't want to lose money if he has to leave the lease, he transfers the right to the next lease. The transfer of rental rights by the tenant to another party will cause problems for the action, the action itself is a form of violation of the agreement previously agreed upon by both parties.
Leasing can be understood as a day-to-day interaction between people who rent out goods. The form of the parties' lease agreement is not expressly determined by the Civil Code. Therefore, both written and verbal lease agreements can be made. However, the party who leases the property has the most influence in setting the terms of the contract, making the lessor the weaker party. As a result, whether the lessee agrees with the lessor's criteria or not, they still apply.
The principle of good faith contained in an agreement and the implementation of the substance of the agreement itself will certainly be seen from the trust between the parties who bind each of them in the rental agreement as intended, as well as good will and responsibility in fulfilling the contents of the agreement. . In this case, good faith means that both parties must treat each other without deceit, without deceit, without disturbing the other party, and not selfishly over the interests of both parties.
The cancellation of an agreement as a result of an act of default should ideally be based on the agreement of the parties in order to protect the interests of the parties as stipulated in article 1338 paragraph (2) of the Civil Code, where agreements cannot be withdrawn other than based on the agreement of the parties bound by the agreement. or for reasons stated sufficient by law
