Hukuman Mati Herry Wirawan dalam Perspektif HAM

Abstract

This journal was motivated by a case that was committed by an ustadz who is also a foundation leader named Herry Wirawan. This case was an incident that was not commendable such as rape until she became pregnant and gave birth which resulted in Herry Wirawan being entangled in the law which is very heavy. The motive for the crime committed by Herry Wirawan was to use female students and their baby as charity to raise funds from the surrounding community. In this journal, the chronology of the Herry Wirawan case is examined in as much detail as possible to find out to what extent this case violated the law and how the law provided justice for the victims and perpetrators of the case. The research objective of this journal is to understand how the imposition of the death penalty for Herry Wirawan on the rape case of female Islamic boarding school students in Bandung can be seen from a human rights standpoint. Human Rights are always felt to protect someone's rights, but are Human Rights appropriate to protect perpetrators of sadistic rape cases. This journal research method is carried out through literature study with qualitative methods by obtaining information from data collection through analysis of articles, news and other literature. The results of research in this journal are that the imposition of capital punishment on the perpetrators of the rape case with the victims of dozens of female students is very inappropriate for human rights protection
