Penelantaran Anak Yatim Piatu Yang Menjadi Korban Tindak Pidana Dalam Kaitannya Dengan Hak Alamiah Menurut John Locke

Abstract

The phenomenon of criminal acts of sexual violence against children in orphanages at the Budi Pertiwi Orphanage in Bandung and one of the orphanages in Cihampelas District, West Bandung Regency (KBB) is the main source of this problem. Because historically this phenomenon takes away the natural rights of children in orphanages as human beings, which is the difference from the side of the victims of the taking away of these natural rights. This research was conducted using normative juridical research methods. In this research the author aims to study and analyze John Locke's views on natural rights and to study and analyze the fulfillment of natural rights for orphaned children who are victims of criminal acts. In this research, the author applies a descriptive analysis method which aims to provide an overview of the facts that occur in the field. In this research, the stages carried out include library research. The results of the research obtained are that John Locke's view of natural rights emphasizes the importance of the basic rights possessed by every individual, and the importance of protecting these rights by the government and orphans who are victims of criminal acts illustrates a serious violation of Natural Rights in his view. John Locke, where children in orphanages should receive protection for their natural rights, but instead become victims of sexual violence committed by the administrators of the orphanage itself.
