Mengenal Perbedaan Aliran Realisme Hukum Amerika Dan Aliran Realisme Hukum Skandinavia Dalam Filsafat Hukum

Abstract
Humans have the advantage of a strong sense of curiosity, which produces knowledge as a characteristic and differentiator in the social environment. Philosophy, especially legal philosophy, tries to answer philosophical questions that arise from deep reflection and contemplation. In the context of legal philosophy, there is a school of legal realism which is divided into America and Scandinavia. Portraits of legal thought are always colored by differences between concepts and thoughts from one another so that there are various opinions and thoughts about law. From this portrait of thought, the researcher raised the topic of differences in Legal Realism. The purpose of this research is to find out how the American legal realism school and the Scandinavian legal realism school differ in legal philosophy in more depth. The approach method used in this research is using a qualitative method with a descriptive approach. According to Denzin & Lincoln (1994) Qualitative Research Methods are research that uses natural settings with the aim of interpreting phenomena that occur and is carried out by involving various existing methods. The Descriptive Approach aims to create systematic, factual and accurate information about the facts and characteristics of a particular population or area. The research results show that there are many differences regarding the American School of Legal Realism and the Scandinavian School of Legal Realism. The important point is that American realism emphasizes aspects of court behavior and pragmatism, Scandinavian realism is more oriented towards psychology and empirical research to understand human behavior in a legal context. Both make valuable contributions to the development of legal thinking, enriching our view of the complexity and dynamics of legal systems. In the context of this research, a comparison of the differences between the American and Scandinavian schools of legal realism creates a rich understanding of the complexity of legal systems.
