Ketidakadilan Hukum Bagi Masyarakat Miskin Dihubungkan Dengan Teori Keadilan Menurut Aristoteles dan Thomas Aquinas

Abstract

In upholding justice and to obtain justice, law enforcers need to act fairly towards parties who are dealing with legal problems, act neutrally regardless of who the parties involved are or in other words apply the principle of Equality Before The Law. Based on facts, the principle of Equality before the law in its application has not been maximized and the author feels that this injustice is not in harmony with the theory of justice in the perspective of Aristotle and Thomas Aquinas so according to the author the title of this study needs to be studied. The method used in this study is the descriptive research method.  The results of this study are connected by the theory of justice according to these two philosophers with legal injustice for the poor, which does not fulfill the theory of justice both according to Aristotle and according to Thomas Aquinas because vindicative justice according to Thomas Aquinas is more likely to lead to retribution for criminal.
