Pandangan Aliran Sociological Jurisprudence Terhadap Perluasan Asas Legalitas Materil Dalam KUHP Nasional

Abstract
Sociological Jurisprudence is a stream in legal philosophy that studies the reciprocal relationship between law and society, with an approach such as starting from law to society. Sociological Jurisprudence's view of the expansion of the principle of material legality in the national Criminal Code creates a philosophical basis that changes the legal paradigm. The principle of material legality states that the basis for punishing a particular act is the law that applies in society. Sociological Jurisprudence's view of the nature of law shows that law, according to Roscoe Pound, is "the will of society." This emphasizes that law is not only static but also dynamic in social life. The Sociological Jurisprudence school views that expanding the principle of legality in the National Criminal Code will have its own consequences. The Sociological Jurisprudence view shows a close relationship with the expansion of the principle of material legality in the context of the National Criminal Code. Sociological Jurisprudence, as a school of legal philosophy, emphasizes the importance of understanding and recognizing the role of society in the formation and application of law. This research has several limitations. The factors that influence the results of this research play a key role in shaping the views of Sociological Jurisprudence, especially in the context of legal politics and reform and changes in the needs of society. One of the main limitations is the scope of the study which may not have fully covered all of these topics. Further research needs to consider more points of view and involve more people, such as legal practitioners and the general public.
