Abstract
The aim of this research is to find out the influence of the application of Hans Kelsen's positivism theory in Indonesia, as well as an analysis of the weaknesses and strengths of applying this theory. The research methods used are normative juridical and philosophical juridical methods which focus on analysis of legal theories and statutory regulations related to positive law. The results of the research show that the influence of positivism can be seen in the adoption of the concept of written positive law which is ratified by the competent authority and is separate from moral values. In court practice in Indonesia, the influence of positivism is manifested in resolving legal problems based on concrete and empirical evidence. A standardized and unified system of legal regulations applies to all citizens, especially in the field of criminal law.
