Penerapan Prinsip Keadilan Sebagai Fairness Menurut John Rawls Di Indonesia Sebagai Perwujudan Dari Pancasila

Abstract
Pancasila is a characteristic that differentiates the Indonesian legal system from others. Pancasila has the characteristics of kinship and justice and prioritizes collective interests above individual interests. John Rawls' theory of justice also emphasizes the values contained in Pancasila, meaning that no one gets the same treatment, everyone is equally treated. on the basis of Pancasila. The aim of this research is to put forward the concept of justice by generalizing it. According to Rawls, justice must be understood as fairness, which means that those who have the ability have the right to enjoy various benefits to open up opportunities for those who are less fortunate to improve their life prospects. The research method used in this research is Qualitative research methods are used in several research activities related to community life, history, behavior, organizational functionalization, social and economic activities. The results of the research found that in Indonesia, with its various legal developments which were influenced by the Dutch legal system which experienced various kinds of changes, ultimately Pancasila became the basis of the Indonesian state, which was inseparable from justice in its content in the 5th principle which reads "Social Justice for All Indonesian People ” which relates to the application of the concept initiated by John Rawls, which is very touching in his theory of justice, that justice is the center of attention in matters of justice, namely how justice can carry out rights and obligations evenly in society.
