Abstract

The development of law in Indonesia cannot be separated from the influence of several main legal philosophical schools, in this case utilitarianism and realism. Utilitarianism focuses on shared happiness and the welfare of society, seen in legal policies aimed at improving social welfare. Meanwhile, realism recognizes the role of social, economic and political factors in shaping law, reflected in responses to social issues.


The aim of this research is to look at the influence of the philosophical schools of utilitarianism and legal realism in the phenomenon of the development of legal science in Indonesia. This research method is a qualitative method with a descriptive analysis approach. This type of research is a literature study sourced from primary and secondary sources. The results of this research are that realism is a school of legal philosophy which holds that law is a product of society and power, where this school emphasizes the reality and practice of law. Second, the flow of utilitarianism influences the fields of law enforcement, punishment systems, legal policies, and social and economic policies and in making these regulations looks more and focuses on the benefits of a rule for the benefit of society itself, while realism influences the process of forming the law itself, which there are court decisions that are used as a source of law that adapt to the development of society. The conclusion obtained from this research is that the development of law in Indonesia is influenced by legal philosophical thinking, where the flow of legal philosophy of utilitarianism and realism does not have too much influence because there are other schools that influence the development of Indonesian law, both in the punishment system, legal policy, law making. -invitations, the form of law itself, whether written law or unwritten law, however, both of these ideas are really needed in Indonesia, which is currently still dominated by positivist thinking.
