Perlindungan Hukum Terhadap Pemain Sepak Bola Atas Keterlambatan Gaji Yang Dilakukan Oleh Klub Sepak Bola Persikab Bandung Pada Liga 2 Tahun 2022

Abstract

Clubs' delays in paying their players' salaries often occur in the Indonesian football environment. As happened to the Persika Bandung Football club in league 2 in 2022, the club is not carrying out its obligations to pay salaries to its players in a timely manner. Article 71 paragraph 1 of the PSSI statute states that PSSI, PSSI Members, Players, Officials, Affiliated Institutions and/or parties affiliated with or related to PSSI cannot submit disputes to State Bodies or Institutions or the General Court. This rule is not in line with Article 88 of Law no. 3 of 2005 concerning the National Sports System, in Article 88 of the SKN Law it is formulated that the settlement of sports disputes can be carried out through deliberation, arbitration or through the courts. The purpose of this study is to find out the form of legal protection for football players who experience delays in payment of wages and legal remedies taken by players against clubs that violate their rights. This research is an empirical normative legal research discussing opinions or principles in the science of law. The normative legal research method examines law from an internal perspective with the object of research being legal norms. The results of this research and discussion show that professional football players in Indonesia are subject to Law No. 13 of 2003 concerning Manpower. The consequence is that when problems arise between players and clubs, in this case delays in payment of wages, the form of legal protection and resolution of problems that can be carried out by players must be based on the provisions of the Labor Law. Based on Lex Sportiva, the legal remedy that players can take when they experience problems with their club is to resolve these problems through the mechanisms provided by FIFA and PSSI.
