FILSAFAT HUKUM DAN KEADILAN SOSIAL: ANALISIS TEORITIS TENTANG PERAN HUKUM DALAM MEWUJUDKAN KESEJAHTERAAN MASYARAKA

Abstract
A fundamental problem in today’s legal system is the tendency to treat law merely as a tool for social control, emphasizing formal certainty without adequately addressing the dimensions of social justice and the needs of vulnerable groups. This results in inequality in the distribution of justice and a disconnection between positive law and the social values that live within society. This study aims to explore the theoretical dimensions of legal philosophy that position social justice as a central orientation, and to formulate how a legal system can be constructed to support the development of societal welfare. The method used is a conceptual approach through a literature review, analyzing the thoughts of legal philosophers—both classical, such as Aristotle and Thomas Aquinas, and contemporary figures like John Rawls and Amartya Sen. The research focuses on interpreting law within the frameworks of ethics, morality, and principles of distributive justice. The results show that an ideal legal system does not merely guarantee formal legal certainty, but functions substantively to address social needs and rectify structural inequalities within society. In conclusion, a just legal system is one that is dynamic and grounded in the living social values of the community, sides with vulnerable groups, and is capable of realizing the principle of social justice as a fundamental foundation for national legal development.
